Application of the regulation on the protection of your personal data (GDPR)

1 - About

 

The GDPR applies to all B2B and B2C companies and organizations, whether or not they are members of the European Union or serving European customers. The principle is that any organization collecting or processing data on EU residents must comply with this new regulation.

By agreeing to create an account or subscribing to our newsletter, you explicitly agree that Ballisa.com may process your data as described in this policy. 2 - Information We Collect

 

Required Information:

 

To open a Ballisa.com customer or business account, you must provide us with your first and last name, title, date of birth, telephone number, email address, and billing and shipping addresses. To make payments through our payment process, you must provide your card or bank account information.

 

Loyalty Program Information:

If you authorize us to link your membership in an eligible loyalty program to your account, we may ask you to provide us with your loyalty program member ID.

 

Information about you from third parties:

 

To protect all our users from the risks of potential fraud, our service providers verify the information you have provided with Payment Processors and/or Credit Reference and Fraud Control Agencies. As part of these verifications, we receive personal information about you from these third-party services. In particular, if you register a card or bank account with PayPal or Facily Pay, Hipay, or Oney payment processors, we verify, through authorization and fraud control services, that the information and address of your card or bank account match the information you provided to Ballisa.com and that the card has not been reported as lost or stolen. We specify that no Personal Data is transferred to the third party, only a link exists.

Ballisa reserves the right to block a customer account if it is suspected of fraud, or even to close an account based on the information obtained during this investigation. Ballisa will then inform you.

 

Additional Verifications:

 

If we cannot verify the information you provide, or if you request a check transfer to an address other than the verified credit card billing address, we may ask you to provide us with additional information by email or fax (e.g., your driver's license, a credit card statement, and/or a recent utility bill, or any other information that can be associated with the address in question), or to answer additional questions online that will allow us to verify your information.

 

Website traffic information:

 

Due to the way web communication channels work today, when you arrive at or leave the Ballisa website, we automatically receive information about the pages of our website you visit, the IP addresses used, the type of browser used, and the times you access our website. Processing of Ballisa Prospect Data:

 

When a user registers as a customer but decides not to use the site, they are classified as a prospect rather than a customer. We collect certain information: title, first and last name, date of birth, email address, and telephone number. Although this information is stored for 5 years to facilitate the process of a possible subsequent purchase, we do not use this information for marketing purposes towards the unregistered person. Prospects have the same rights to view and correct information as our customers.

Recruitment and Applications

 

The personal information collected is processed electronically in accordance with the law of June 20, 2018, for the purpose of managing and tracking applications via recruitment software on our Website. The data controller is Ballisa (see "Identity of the data controller").

 

The data collected is intended for use by Ballisa and is retained for a period of two years from the last contact with the candidate.

We use your email address to confirm the opening of your customer account. If your customer account remains inactive for 5 years (no orders recorded), we undertake to no longer use your data for commercial purposes. However, for accounting reasons (billing), we must keep a record of your personal data.

 

A KBIS (Business Registration Certificate) will be requested to verify your professional status before validating your professional account. This document will not be kept, but may be requested annually for the renewal of your professional account.

 

NEWSLETTER SUBSCRIPTION

 

By subscribing to the newsletter, you agree that we may use your personal information to:

Send you commercial content related to the category to which you have subscribed

 

We use your email address to confirm your newsletter subscription. We will retain your data for a period of 6 months. If you do not reactivate your subscription, your Ballisa newsletter subscriber account will be deleted. You will no longer receive emails; you will need to create a new account to receive content again.

During the newsletter registration process or later, you can choose to receive some or all communications. Simply log in to your account and go to the newsletter section to manage your preferences.

 

In the context of communications with our customer service, technical support, and/or after-sales service, we may communicate via email to facilitate communication.

 

4 - Marketing

 

If you do not wish to receive marketing communications from us or participate in our advertising personalization programs, log in to your account, click on My Account, Preferences, then Notification Settings and update your communication preferences, or follow the instructions indicated in the communication or advertisement in question.

The security of your Ballisa account also depends on how well you protect your password. You should not share your Ballisa password with anyone. Ballisa representatives will never ask you for your password. If you believe someone may have accessed your password, we recommend that you change it immediately by logging into your account. All these provisions also apply to subcontractors.

 

7 - Access to your information for modification, retrieval, deletion, or access by the DPO.

 

You can review your personal information by logging into your Ballisa customer account. You can also close your account from the website. By doing so, we notify our database that your customer account is "Closed," but we must retain the information associated with it, particularly for accounting purposes to prevent potential fraud.

 

Regarding account deletion, you will be asked for a copy of your national identity card to prove your identity so that our dedicated department can validate the request. Your ID will not be retained after account deletion has been validated.
